| DECISION & ORDER ON MOTION |
Motion by the respondent Brooklyn Reliable Holding, Inc., in effect, to dismiss an appeal from an order of the Supreme Court, Queens County, entered September 19, 2016, on the grounds that the appellant failed to serve the record and brief upon it, that no appeal lies from a decision, and that the notice of appeal misidentifies the Court from which the order originates, or, in the alternative, to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to enlarge the movant's time to serve and file a brief is granted, the movant's time to serve and file a brief is enlarged until December 20, 2017, and the movant's brief shall be served and filed on or before that date; and it is further,
ORDERED that the motion is otherwise denied.
