DECISION & ORDER ON MOTION

Motion by the appellant pro se to enlarge the time to perfect an appeal from a judgment of the Supreme Court, Nassau County, rendered June 16, 2015, and, in effect, to hold the appeal in abeyance pending determination of his proposed motion pursuant to CPL 440.10 by the Supreme Court, Nassau County.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal is granted, the appellant's time to perfect the appeal is enlarged, and the appellant shall prosecute the appeal expeditiously in accordance with this Court's rules (see 22 NYCRR 670.1, et seq.) and written directions; and it is further,

ORDERED that the branch of the motion which is, in effect, to hold the appeal in abeyance is denied.
