DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from an order of the Supreme Court, Kings County, dated February 11, 2016, inter alia, to extend the time to comply with so much of a decision and order on motion of this Court dated April 12, 2017, as directed him to serve and file a replacement record and a replacement appellant's brief which do not contain or refer to matter dehors the record.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted to the extent that on or before January 8, 2018, the appellant shall serve and file a replacement record and a replacement appellant's brief which do not contain or refer to matter dehors the record, and the motion is otherwise denied; and it is further,

ORDERED that no further extensions of time shall be granted; and it is further,

ORDERED that on the Court's own motion, the respondent's time to serve and file a brief is enlarged until February 7, 2018, and the respondent's brief if any, shall be served and filed on or before that date.
