| DECISION & ORDER ON MOTION |
Motion by the respondent to strike the appellant's brief on an appeal from an order of the Supreme Court, Suffolk County, dated June 22, 2016, to direct the appellant to serve and file a replacement brief, and to enlarge the respondent's time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, the appellant's brief is stricken, and on or before December 22, 2017, the appellant shall serve and file a replacement brief in the form annexed to the papers filed in connection with this motion; and it is further,
ORDERED that the respondent's time to serve and file a brief is enlarged until January 22, 2018, and the respondent's brief shall be served and filed on or before that date.
