| DECISION & ORDER ON MOTION |
Motion by the appellant to recall and vacate a decision and order on motion of this Court dated December 28, 2016, which, inter alia, dismissed an appeal from an order of the Family Court, Kings County, dated July 21, 2016, and reinstate the appeal, and to vacate an order of support and to direct repayment of money paid pursuant to the order of support.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to recall and vacate the decision and order on motion of this Court dated December 28, 2016, and reinstate the appeal is denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
