DECISION & ORDER ON MOTION

Motion by the appellant for leave to reargue an appeal from a judgment of the County Court, Nassau County, rendered October 10, 2007, which was determined by decision and order of this Court dated February 3, 2009, and for leave to reargue his prior motion to waive payment of restitution, which was determined by decision and order on motion of this Court dated July 27, 2017. Separate motion by the appellant pursuant to CPLR 3215 "for leave to enter a judgment upon default" against the respondent.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the motions are denied.
