An appeal having been taken to this Court from the order of the Supreme Court, New York County, entered on or about August 31, 2017, And plaintiff-appellant having moved for a stay of the order to the extent it directs him to pay $35,000 in counsel fees to counsel for defendant-respondent, pending hearing and determination of the aforesaid appeal, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of staying that part of the order directing the counsel fee award on condition plaintiff-appellant perfects the appeal on or before January 29, 2018 for the April 2018 Term.
