| DECISION & ORDER ON MOTION |
Motion by the appellant to enlarge the time to perfect an appeal from an order of the Supreme Court, Kings County, dated January 27, 2017, and to disregard a discrepancy between the spelling of the appellant's first name in the order appealed from and the spelling of the appellant's first name on the covers of the proposed record and appellant's brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal is granted, the appellant's time to perfect the appeal is enlarged until January 8, 2018, and the record or appendix on the appeal and the appellant's brief shall be served and filed on or before that date; and it is further,
ORDERED that the branch of the motion which is to disregard any discrepancy in the spelling of the appellant's first name is granted to the extent that the spelling of the appellant's first name on the covers of the record and appellant's brief shall conform to the spelling in the complaint in this action.
