DECISION & ORDER ON MOTION

Motion by the appellant to stay enforcement of an order of the Supreme Court, Suffolk County, dated September 19, 2017, pending hearing and determination of an appeal therefrom, and for poor person relief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to stay enforcement of the order dated September 19, 2017, is denied; and it is further,

ORDERED that the branch of the motion which is for poor person relief is denied, with leave to renew on or before January 10, 2018, upon proper papers, including the appellant's affidavit setting forth the appellant's full financial situation including all assets, both real and personal, including the value of any real property owned by the appellant and the amount of all debts encumbering the real property, as well as any and all sources of income and expenses, and the amount and source of counsel fees paid to retained counsel and other litigation expenses, such as transcripts, in the Supreme Court.
