An order of this Court having been entered on June 17, 2008 (M-2165), inter alia, denying defendant's pro se motion for an extension of time to file a notice of appeal from the judgment of the Supreme Court, Bronx County, rendered on or about December 10, 2004, as time barred pursuant to CPL § 460.30[1],And defendant having moved for an order, in the nature of a writ of error coram nobis, on the ground that he was allegedly denied effective assistance of counsel by reason of counsel's failure to file a timely notice of appeal on his behalf and, accordingly, for an extension of time to file said notice of appeal from the aforesaid judgment, and for poor person relief, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,It is ordered that the motion is denied.
