DECISION & ORDER ON MOTION

Motion by the appellant to stay enforcement of a decision of the Supreme Court, Kings County, dated December 1, 2016, and a judgment of the same court dated April 4, 2017, pending hearing and determination of appeals therefrom. Cross motion by the respondent to dismiss the appeals as untimely taken.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the cross motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that on the Court's own motion, the appeal from the decision is dismissed, without costs or disbursements, on the ground that no appeal lies from a decision (see Schicchi v J.A. Green Constr. Co., 100 AD2d 509); and it is further,

ORDERED that the motion is denied; and it is further

ORDERED that the branch of the cross motion which is to dismiss the appeal from the decision is denied as academic, and the cross motion is otherwise denied.
