| DECISION & ORDER ON MOTION |
Motion by the respondent (1) for leave to file responsive papers in connection with a motion by the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts to confirm a report of a Special Referee, which was determined by an opinion and order of this Court dated June 21, 2017, (2) to vacate the opinion and order of this Court dated June 21, 2017, (3) to impose a sanction no greater than a censure, and (4), in effect, to stay enforcement of the opinion and order of this Court dated June 21, 2017, pending determination of this motion. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on June 25, 1997. The opinion and order of this Court dated June 21, 2017, suspended the respondent from the practice of law for a period of one year, commencing July 21, 2017 (see Matter of Taller, 152 AD3d 84).
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branch of the motion which is for leave to file responsive papers in connection with the motion to confirm the report of the Special Referee is granted, the respondent's papers are considered in connection with the motion to confirm the report of the Special Referee, this Court adheres to its original determination, and the opinion and order of this Court dated June 21, 2017, is amended by adding thereto the following appearance paragraph after the appearance paragraph for Diana Maxfield Kearse:

and it is further,
ORDERED that the branches of the motion which are to vacate the opinion and order of this Court dated June 21, 2017, and to impose a sanction no greater than a censure are denied; and it is further,
ORDERED that the branch of the motion which is , in effect, to stay enforcement of the opinion and order of this Court dated June 21, 2017, is denied as academic.
