Vahid Jadidian, Appellant, v The Hive Sports Bar & Grill, Inc., Respondent and XYZ Corp., Undertenant.

Appellant Vahid Jadidian, having appealed to this court from an order of the Civil Court of the City of New York, Queens County, dated March 22, 2017, and appellant's counsel, Robert B. Goldstein, Esq., having moved for leave to withdraw as counsel for the appellant on July 19, 2017, and the court having granted counsel's motion in a Decision & Order on Motion dated August 11, 2017, and counsel having been directed in said order to "serve his client by one of the methods specified in CPLR 2103 (c), with a copy of this decision and order on motion" by August 31, 2017 and "file proof of such service with the clerk of this court," and no such proof of service having been filed with the clerk to date despite several calls to counsel's office by the clerk's office,

Now, on the court's own motion, it is

ORDERED that Robert B. Goldstein, Esq. is directed to show cause before this Court why an order should or should not be made and entered imposing such sanctions and/or costs, if any, against him pursuant to the Rules of the Chief Administrator of the Courts (22 NYCRR) § 130-1.1, as this Court may deem appropriate by filing an affirmation on that issue in the office of the Clerk of this Court and serving one copy of the same on all parties to the action on or before January 16, 2018.

The Clerk of this Court, or his designee, is directed to serve a copy of this order to show cause upon counsel for the respective parties by regular mail.
