Motion by the petitioner to stay the trial in an action entitled People v Peters, pending in the Supreme Court, Kings County, under Indictment No. 8885-15, pending hearing and determination of the above-entitled proceeding pursuant to CPLR article 78.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied as academic in light of the determination of the proceeding (see Matter of Peters v Del Giudice, __ AD3d __, [2d Dept, December 27, 2017]).
