Plaintiff-respondent having moved to dismiss the appeal taken from an order of the Supreme Court, New York County, entered on or about January 10, 2017 or, in the alternative, granting plaintiff poor person relief to respond to said appeal (M-6703), And defendant-appellant having cross-moved for an enlargement of time to perfect the aforesaid appeal (M-6545), Now, upon reading and filing the papers with respect to the motion and cross motion, and due deliberation having been had thereon, It is ordered that the motion to dismiss the appeal is granted unless said appeal is perfected for the May 2018 Term, and is otherwise denied (M-6703).
