DECISION & ORDER ON MOTION

Motion by the appellant's assigned counsel on an appeal from an order of the Supreme Court, Kings County, dated August 3, 2016, in effect, to be relieved on the ground that the appellant has absconded and is not presently available to obey the mandate of the Court.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is dismissed without prejudice to renew upon proper papers, including proof of service upon the appellant at his last known place of residence (see CPL 470.60[2]).
