| DECISION & ORDER ON MOTION |
Motion by the appellant to stay enforcement of an order of the Supreme Court, Queens County, dated November 8, 2017, pending hearing and determination of an appeal therefrom.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, and enforcement of the order is stayed pending hearing and determination of the appeal on condition that on or before February 26, 2018, the appellant perfect the appeal and deliver the subject documents to the Clerk of the Supreme Court, Queens County, and file a receipt or other proof of delivery with the Clerk of this Court; upon delivery, the Clerk of the Supreme Court, Queens County, shall take custody of the documents and hold the documents until further order of this Court; and it is further,
ORDERED that in the event the appellant does not comply with the foregoing provision, the Court, on its own motion, may vacate the stay, without further notice, or the respondents may move to vacate the stay, on three days notice.
