Motion by the petitioner for leave to reargue a proceeding pursuant to CPLR article 78 in the nature of prohibition to prohibit the respondents from retrying the petitioner in a criminal action entitled People v Jose Palacios, pending in the County Court, Nassau County, under Indictment No. 413N/16, which was determined by decision and judgment of this Court dated September 27, 2017.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
