Motion by the plaintiff-respondent, inter alia, to stay the defendant-respondent and the nonparty-appellant from enrolling new students in a certain charter school for the 2018-2019 academic year, pending hearing and determination of an appeal from an order of the Supreme Court, Queens County, entered September 6, 2017, and for a preference in the calendaring of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
