Motion by NMD Realty Holding, LLC, for leave to intervene on an appeal from an order of the Supreme Court, Suffolk County, dated March 24, 2017.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied as unnecessary as NMD Realty Holding, LLC, is a respondent on the appeal; and it is further,
ORDERED that on the Court's own motion, the nonparty-respondent's time to serve and file a brief is enlarged until March 22, 2018, and the nonparty-respondent's brief shall be served and filed on or before that date; and it is further,
ORDERED that on the Court's own motion, the appellant shall serve and file a reply brief in response to the nonparty-respondent's brief, if any, on or before April 6, 2018.
