| DECISION & ORDER ON MOTION |
Motion by the appellant pro se on appeals from an order of the Supreme Court, Suffolk County, dated January 5, 2016, and a judgment of the same court entered March 16, 2016, to waive compliance with the requirements of 22 NYCRR 670.10.2(f) regarding certification of the appellant's replacement appendix. Cross motion by the respondent to dismiss the appeal for failure to comply with a decision and order on motion of this Court dated December 6, 2017.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the cross motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the cross motion is denied; and it is further,
ORDERED that on the Court's own motion, the respondent's time to serve and file a brief is enlarged until March 22, 2018, and the respondent's brief shall be served and filed on or before that date.
