Respondent having moved to dismiss the appeals taken herein from an order and an order and judgment of the Supreme Court entered in the Office of the Clerk of the County of Niagara on July 12, 2017 (CA 18-00132), and October 11, 2017 (CA 18-00133),
Now, upon reading and filing the affirmation of Gregory V. Pajak, Esq., dated January 24, 2018, the notice of motion with proof of service thereof, and the affirmation of Richard T. Saraf, Esq., dated February 5, 2018, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to dismiss the appeal from the order entered July 12, 2017, is granted, and
It is further ORDERED that the motion insofar as it seeks to dismiss the appeal taken from the order and judgment entered October 11, 2017, is granted and the appeal is dismissed without further order unless the appeal is perfected on or before April 23, 2018.
