Respondent having moved for permission to file and serve a late brief for the appeals taken from a judgment of the Cayuga County Court, rendered February 24, 2015, the order of Cayuga County Court entered May 5, 2015, which denied defendant's request for forensic DNA testing of evidence pursuant to CPL 440.30 (1-a) and the order of Cayuga County Court entered May 20, 2015,

Now, upon reading and filing the affidavit of Christopher T. Valdina, Esq. sworn to February 2, 2018, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and the time to file and serve a respondent's brief is extended to February 26, 2018, and

It is further ORDERED that the time to file and serve a reply brief be and the same hereby is extended to March 13, 2018.
