Pursuant to NY Constitution article VI, § 4(i), it is
ORDERED that the above-entitled proceeding, inter alia, pursuant to CPLR article 78 to declare invalid certain criminal proceedings brought against the petitioner and for poor person relief, is transferred to the Appellate Division, Third Department, for hearing and determination; and it is further,
ORDERED that all further proceedings in connection with this proceeding shall be conducted pursuant to the rules of the Appellate Division, Third Department.
