Plaintiff having moved for an extension of time to file and serve a reply brief in the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Niagara on December 13, 2016 (appeal No. 1), and for an extension of time to file and serve a respondents brief appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Niagara on July 25, 2017 (appeal No. 2),

Now, upon reading and filing the affidavit of Brian R. Hogan, Esq., sworn to February 13, 2018, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks to file and serve a reply brief in appeal No. 1 is granted to the extent that the ordering paragraph of the order of this Court entered February 5, 2018, is hereby amended by deleting the date February 21, 2018, and inserting in its place the date March 15, 2018, and

It is further ORDERED that the motion insofar as it seeks to file and serve a respondent's brief in appeal No. 2 is granted to the extent that the first ordering paragraph of the order of this Court entered January 23, 2018, is hereby amended by deleting the date February 15, 2018, and inserting in its place the date March 2, 2018, and

It is further ORDERED that defendants' reply brief in appeal No. 2, if any, shall be filed and served on or before March 15, 2018.
