On the Court's own motion, it is
ORDERED that the decision and order on motion of this Court dated September 1, 2017, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:
Appeal by Harpreet Singh from an order of the Supreme Court, Queens County, dated July 11, 2016. By order to show cause dated March 7, 2017, the appellant was directed to show cause before this Court why the appeal should not be dismissed on the ground that the order dated July 11, 2016, was not appealable as of right and leave to appeal had not been granted.
Now, upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the motion to dismiss the appeal is denied in light of the decision, order and certificate of this Court dated August 17, 2017, which granted leave to appeal to this Court from the order dated July 11, 2016.
