People v Alegria, Victor
It is Ordered that the motion is granted to the extent of granting appellant leave to appeal as a poor person. Seymour W. James, Jr., Esq. of the Legal Aid Society, Criminal Appeals Bureau (199 Water Street, 3rd Floor, NY, NY 10038, Tel # 212-577-3688) is assigned as counsel for the appellant to prosecute the appeal and to serve without compensation.
It is further Ordered that assigned counsel shall serve a copy of the transcript, with a copy of the file, on the office of the District Attorney simultaneously with the appellant's brief and notice of argument. Upon request, the District Attorney's office will return the transcript and file to appellant's counsel after argument or submission of the appeal.
It is further Ordered the Appeals Clerk is directed to file the original transcript with the record, which will then be filed with this court.
It is further Ordered that upon service of a copy of this order upon the Department of Probation, said Department is authorized and directed to provide assigned counsel with a copy of the pre-sentence report prepared in connection with the defendant's sentencing, including the recommendation sheet and any prior reports concerning the defendant which are incorporated or referred to in the report.
