| DECISION & ORDER ON MOTION |
Motion by the appellant to stay enforcement of stated portions of an order of the Supreme Court, Nassau County, dated December 19, 2017, pending hearing and determination of an appeal from the order.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted to the extent that enforcement of so much of the order as directed the appellant to pay the respondent's monthly rent and pay maintenance in the sum of $7,000 per month is stayed pending hearing and determination of the appeal on condition that the appellant (1) pay maintenance in the sum of $5,000 per month and (2) perfect the appeal on or before April 16, 2018, and the motion is otherwise denied; and it is further,
ORDERED that in the event the appellant does not comply with the foregoing provision, the Court, on its own motion, may vacate the stay, without further notice, or the respondent may move to vacate the stay, on three days notice.
