Motion by the appellant-respondent on an appeal and cross appeal from an order of the Supreme Court, Nassau County, dated September 6, 2016, to dismiss the cross appeal on the ground that the respondent-appellant is not aggrieved, to strike the respondent-appellant's answering brief and reply brief, and to preclude the respondent-appellant from filing a brief. Cross motion by the respondent-appellant and Freeman Expositions, Inc., for relief pursuant to CPLR 2001, if necessary.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the cross motion is denied as academic.
