DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Christopher Basile, Appellant.

Motion by Green & Willstatter, retained counsel for appellant on an appeal from a judgment of conviction of the Justice Court of the Village of Larchmont, Westchester County, rendered April 18, 2017, for leave to withdraw as counsel, to allow appellant to proceed pro se, and to enlarge the time to serve and file a reply brief. Subsequent to the making of this motion, this court received a notice substituting appellant pro se for retained counsel and, thereafter, a second notice substituting new counsel in place of appellant pro se.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the branches of the motion seeking to allow retained counsel to withdraw and appellant to proceed pro se are denied as moot, as new counsel has been substituted; and it is further,

ORDERED that the branch of the motion seeking an enlargement of time to serve and file a reply brief is granted and appellant's time to serve and file a reply brief is enlarged to May 4, 2018.
