| DECISION & ORDER ON MOTION |
Appeal by Luis Gonzalez from an order of the Supreme Court, Kings County, dated July 20, 2017. By order to show cause dated February 6, 2018, the appellant was directed to show cause before this Court why the appeal should not be dismissed on the ground that the order dated July 20, 2017, was neither appealable as of right nor by permission. Application by the appellant to extend his time to make an application pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from the order dated July 20, 2017.
Now, upon the order to show cause and the papers filed in response thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed (see CPL 450.10, 450.20); and it is further,
ORDERED that the application is granted and the appellant's time to make an application pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from the order dated July 20, 2017, is extended until April 30, 2018.
