| DECISION & ORDER ON MOTION |
Appeal by Nancy Cave from an order of the Surrogate's Court, Nassau County, dated June 16, 2015. By order to show cause dated February 9, 2018, the parties to the appeal were directed to show cause why the appeal should or should not be dismissed on the ground that it had been rendered academic by a stipulation of settlement of the parties dated July 6, 2016.
Now, upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements.
LEVENTHAL, J.P., MILLER, DUFFY and LASALLE, JJ., concur.
