ORDER TO SHOW CAUSE

The People of the State of New York, Respondent, v Christopher G. Scheck, Appellant.

Appeal from a judgment of conviction of the Justice Court of the Town of Monroe, Orange County, rendered January 31, 2018.

On the court's own motion, it is

ORDERED that appellant is directed to show cause before this court why the above-entitled appeal should or should not be dismissed on the ground that the appeal was not properly taken in that the record on appeal contains no proof that appellant served a copy of the notice of appeal upon the People in compliance with CPL 460.10 (1) (b), by filing an affidavit or affirmation on that issue with the Clerk of this court on or before April 23, 2018; and it is further,

ORDERED that the Clerk of this court, or his designee, is directed to serve a copy of this order to show cause on the parties by regular mail.

Appellant, if so advised, may move pursuant to CPL 460.10 (6) for an extension of time to serve the notice of appeal upon the People.
