Appellant having moved for an extension of time to file and serve a pro se supplemental brief on the appeal taken from a judgment of Supreme Court, Monroe County, rendered August 16, 2012 for Indictment 2011-0013 (KA 12-02145) and the appeal taken from the judgment of Supreme Court, Monroe County, rendered August 16, 2012 for Indictment 2010-1082 (KA 12-01720),
Now upon reading and filing the statement of Jeffrey Terborg dated March 26, 2018, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that appellant may file 10 copies of a pro se supplemental brief for the appeal taken from the judgment of Supreme Court, Monroe County, rendered August 16, 2012 for Indictment 2011-0013 (KA 12-02145), with proof of service of one copy on assigned counsel and the People pursuant to 22 NYCRR 1000.3 (f), on or before May 7, 2018, and
It is further ORDERED that respondent may file a brief in response to the pro se supplemental brief for the appeal from Indictment 2011-0013 (KA 12-02145), if any, on or before May 22, 2018,
It is further ORDERED that the motion insofar as it seeks relief for the appeal taken from the judgment of Monroe County, Supreme Court, rendered August 16, 2012 for Indictment 2010-1082 (KA 12-01720) is dismissed as unnecessary.
Memorandum: No further extensions will be granted for the filing of a pro se supplemental brief.
