Motion by the respondent John F. O'Neill to dismiss, insofar as asserted against him, a proceeding pursuant to CPLR article 78 which was transferred to this Court by order of the Supreme Court, Suffolk County, dated July 20, 2017.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted and the proceeding is dismissed insofar as asserted against the respondent John F. O'Neill, without costs or disbursements (see LoBlanco v Hansell, 83 AD3d 1072).
