DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Robert Cox, Appellant.

Motion by appellant to vacate the dismissal on an appeal from a judgment of conviction of the Justice Court of the Town of Eastchester , Westchester County, rendered March 15, 2017.

Upon the papers filed in support of the motion and the papers having been filed in opposition thereto, it is

ORDERED that the motion is granted, and the court's order dismissing the appeal is vacated; and it is further

ORDERED that on the court's own motion, appellant's time to perfect the appeal is hereby enlarged and the appellant's brief shall be served and filed on or before May 7, 2018.

It should be noted that the transcripts of the proceeding must be settled by the judge or justice before whom the action was tried (Rules of he Appellate Terms, Second Department [22 NYCRR] § 732.1[b][1]).
