Appellant having moved for an order remitting the case to Supreme Court, Monroe County for a Rodriguez hearing, and for other relief,
Now, upon reading and filing the affirmations of Mary P. Davison, Esq. dated March 15, 2018, the notices of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion seeking a remittal for a Rodriguez hearing is denied with leave to renew this argument in briefing, and
It is further ORDERED that the motion seeking to enlarge the record on appeal is granted to the extent that the appeal is removed from the day calendar of May 15, 2018, and
It is further ORDERED that the appeal is added to the term commencing on June 18, 2018, and
It is further ORDERED that counsel for appellant shall file a supplemental record containing the omnibus motion filed by trial counsel pursuant to 22 NYCRR 1000.3 (c)(1), and 10 copies of a supplemental brief, with proof of service of one copy on the People on or before April 23, 2018, and
It is further ORDERED that respondent shall file a brief in response to the supplemental brief, if any, on or before May 23, 2018, and
It is further ORDERED that the time to file and serve a reply brief, if any, is extended to June 7, 2018.
