ORDER TO SHOW CAUSE
| The People of the State of New York, Respondent, v Howard Salten, Appellant. |
Motion by appellant, pursuant to CPL 460.50, for a stay of execution of judgments of conviction of the Justice Court of the Town of Southampton, Suffolk County, dated January 26, 2018.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED, on the court's own motion, that the parties show cause before this court why the above-entitled appeal should or should not be dismissed as no notice of appeal has been filed with the Justice Court of the Town of Southampton, Suffolk County, and appellant did not seek leave to file a late notice of appeal (see CPL 460.10, 460.30), by filing an affidavit or affirmation on that issue with the Clerk of this court on or before May 8, 2018; and it is further,
ORDERED that appellant's motion is held in abeyance in the interim; and it is further,
ORDERED that the Clerk of this court, or his designee, is directed to serve a copy of this order to show cause on the parties' attorneys by regular mail.
