Motion by the respondent for leave to reargue an appeal from an order of the Supreme Court, Kings County, dated April 29, 2016, which was determined by decision and order of this Court dated January 18, 2017, or, in the alternative, to vacate so much of the decision and order of this Court dated January 18, 2017, as awards costs to the appellant or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court.
