Jeffrey Lubin and Suzanne Lubin, Respondents, v Paige East, Appellant, et al, Undertenants.

Motion by appellant on an appeal from an order of the District Court of Nassau County, First District, entered April 28, 2017, to reinstate and continue a stay granted by decision and order on motion of this court dated July 19, 2017, which was vacated by decision and order on motion of this court dated February 20, 2018, for a stay of a separate holdover proceeding, and for an enlargement of time to perfect the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branches of the motion seeking to reinstate and continue the stay and for a stay of a separate holdover proceeding are denied; and it is further,

ORDERED that the branch of the motion seeking an enlargement of time to perfect the appeal is denied as unnecessary (see Rules of the App Term, 9th & 10th Jud Dists [22 NYCRR] §§ 732.4 and 732.8 [a]).
