On the Court's own motion, it is
ORDERED that the decision and order on motion of this Court dated April 26, 2018, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:
Motion by the respondents Travelocity.com, L.P., Site59.com, LLC, Priceline.com, Incorporated, and Travelweb, LLC, for leave to file certain documents under seal on appeals from two orders of the Supreme Court, Nassau County, dated November 24, 2016, and March 22, 2017, respectively, and a judgment of the same court entered June 1, 2017, or, in the alternative, to enlarge the time to serve and file a brief in connection with the appeals. Application by the respondents Hotels.com, Hotwire, Inc., Expedia, Inc., Orbitz, LLC, Internetwork Publishing Corp. (d/b/a Lodging.com), and Trip Network, Inc. (d/b/a Cheaptickets.com), pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief in connection with the appeals.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branch of the motion which is for leave to file certain documents under seal is granted to the extent that the documents filed under seal as part of the motion papers pursuant to the order to show cause of this Court dated April 9, 2018, shall remain sealed in connection with this motion, and the branch of the motion is otherwise denied without prejudice to renew upon proper papers including a copy of the stipulation between the parties referenced in the motion papers; and it is further,
ORDERED that branch of the motion which is to enlarge the time to serve and file a brief and the application for an enlargement of time to serve and file a brief are granted, the respondents' time to serve and file their briefs is enlarged until May 29, 2018, and the respondents' briefs shall be served and filed on or before that date.
