Motion by respondent to enlarge the time to serve and file a respondent's brief on an appeal from a judgment of conviction of the District Court of Suffolk County, Suffolk County Traffic and Parking Violations Agency, rendered January 19, 2017. Cross motion by appellant to, among other things, disqualify Justin W. Smiloff from acting as counsel prosecuting the appeal.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and the respondent's brief shall be served and filed within 21 days from the date of this decision and order on motion; and it is further,
ORDERED that appellant, if so advised, may serve and file a reply brief within 14 days from the service of the respondent's brief; and it is further,
ORDERED that the cross motion is denied.
