NSD 343 LLC v Dionisatos, Haralambos
It is Ordered that the motion of the respondent-appellant for an order staying the enforcement of the final judgment and warrant of eviction is granted on condition that: (1) The New York City Department of Human Resources Administration deposit the sum of $8,274.00 with the Clerk of the Civil Court on behalf of the respondent-appellant, without prejudice. Said monies shall be deposited with the Clerk of the Court on or before June 8, 2018. The payee on all checks shall be designated pursuant to the instructions of the Clerk of the Civil Court; (2) respondent-appellant perfects his appeal by no later than the October 2018 term, the filing deadline for which is August 7, 2018; and (3) respondent-appellant continues to pay landlord accruing use and occupancy in the amount reserved in the most recent lease agreement on or before each subsequent rental due date, without prejudice. In the event of respondent-appellant's failure to comply with the foregoing conditions, petitioner-respondent may move on five days notice, for an order vacating the stay.
