Sixth Lenox Terrace Assoc. v Donaldson, Loretta L.
It is Ordered that the respondent-appellant's motion seeking to stay the enforcement of the final judgment and warrant of eviction pending the determination of the appeal is granted on condition that the respondent-
appellant: 1) perfect the appeal by no later than the October 2018 term - the filing deadline for which is August 7, 2018; 2) pay landlord the outstanding arrears of $6,912.90, without prejudice; and 3) pay landlord accruing use and occupancy in the amount of $2,278.29 per month, on or before each subsequent rental due date, without prejudice. The outstanding arrears of $6,912.90, if not already paid, shall be tendered within 10 days after service of a copy of this order. In the event of respondent-appellant's failure to comply with the foregoing conditions, landlord-respondent may move, on five days notice, for an order vacating the stay.
