DECISION & ORDER ON

Motion by Martin N. Kroll for reinstatement to the Bar as an attorney and counselor-at-law, which was held in abeyance while the matter was referred to the Committee on Character and Fitness to investigate and report on Mr. Kroll's character and general fitness to practice law, by decision and order on motion of this Court dated July 13, 2016. Mr. Kroll was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on March 18, 1964, under the name Martin Neil Kroll. By opinion and order of this Court dated March 3, 2009, Mr. Kroll was disbarred upon his resignation and his name was stricken from the roll of attorneys and counselors-at-law. By letter, Mr. Kroll asked to withdraw his motion.

Now, on the Court's own motion, it is

ORDERED that the decision and order on motion of this Court dated July 13, 2016, is recalled and vacated, and the motion for reinstatement to the Bar as an attorney and counselor-at-law is deemed withdrawn.
