The People, etc., respondent, v Andriy Komynar, appellant. (Ind. No. 7884/14)
| DECISION & ORDER ON MOTION |
Appeal by the defendant from an order of the Supreme Court, Kings County, dated October 14, 2015. By order to show cause dated April 24, 2018, the appellant was directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the order dated October 14, 2015, was not appealable either by right or by permission.
Now, upon the order to show cause and no papers having been filed in response thereto, it is
ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed (see CPL 450.10; 450.15).
DILLON, J.P., LEVENTHAL, ROMAN and DUFFY, JJ., concur.
