An Article 78 proceeding to review a determination of respondent having been transferred to this Court, pursuant to CPLR 7804(g), by order of the Supreme Court, New York County, entered on or about February 16, 2017, And by order entered November 2, 2017 (M-4301), this Court granted petitioner poor person relief and a stay of eviction on condition the proceeding was perfected for the May 2018 Term, And respondent having moved for dismissal of the aforesaid proceeding for failure to timely prosecute,Now, upon reading and filing the papers with respect to said motion, and due deliberation having been had thereon, It is ordered that the motion is granted and the proceeding is dismissed.
