| DECISION & ORDER ON MOTION |
Motion by Gustavia Home, LLC, to amend the caption to be substituted for Mortgage Electronic Registrations Systems, Inc., on an appeal from an order of the Supreme Court, Kings County, dated April 24, 2017, and to enlarge the time to serve and file a brief. Application by Gustavia Home, LLC, pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the application, and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to amend the caption to be substituted for Mortgage Electronic Registrations Systems, Inc., is denied without prejudice to seeking appropriate relief in the Supreme Court, Kings County; and it is further,
ORDERED that the branch of the motion which is to enlarge the time of Gustavia Home, LLC, to serve and file a brief and the application for that relief are denied as academic.
