DECISION & ORDER ON MOTION

Motion by the appellants to stay all proceedings in the above-entitled action and to stay the sale of the subject premises, pending hearing and determination of an appeal from an order of the Supreme Court, Nassau County, entered January 31, 2017. Separate motion by the appellants to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the motions are granted; and it is further,

ORDERED that all proceedings in the above-entitled action and the sale of the subject premises, located at 1775 Cedar Swamp Road, Brookville, New York, are stayed pending hearing and determination of the appeal on condition that the appeal is perfected on or before July 13, 2018; and it is further,

ORDERED that the time to perfect the appeal is enlarged until July 13, 2018, and the record or appendix on the appeal and the appellant's brief shall be served and filed on or before that date; and it is further,

ORDERED that no further enlargement of the time to perfect the appeal shall be granted; and it is further,

ORDERED that in the event the appeal is not perfected on or before July 13, 2018, the Court, on its own motion, may dismiss the appeal and vacate the stay, without further notice, or the respondent may move to vacate the stay, on three days notice.
