DECISION & ORDER ON MOTION

Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Kings County, dated March 20, 2017, for failure to timely perfect. Cross motion by the appellant, inter alia, to stay the sale of the subject premises and, in effect, to preclude the respondent from filing a brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the cross motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied; and it is further

ORDERED that the branch of the cross motion which is to preclude the respondent from filing a brief is granted; and it is further,

ORDERED that the cross motion is otherwise denied.
